Ethics Complaint Packet
Prior to filing a complaint, you are encouraged to contact your agent and/or their broker to ensure they are aware of your issues; they may be able to satisfactorily resolve the issues before it rises to an official complaint.
In formulating your ethics complaint, ensure that you refer to specific articles of the Code of Ethics
, so that our Grievance Committee can determine whether or not evidence exists sufficient to warrant the holding of a Professional Standards hearing. Please include a typewritten explanation of the circumstances that prompted you to file your complaint.
Further--and this is important--please understand that when a REALTOR® is charged with a violation of the Code of Ethics, the complaining party cannot recover damages, either actual or punitive. Should a REALTOR® be found guilty of violation of one or more articles of the Code of Ethics he may receive a letter of reprimand, a fine up to $15,000, suspension of membership, required attendance at an educational seminar, or termination of membership. The Board of REALTORS® is not empowered to force a REALTOR® to pay damages of any kind.
As soon as the complaint is fully completed and returned to the Board, it will be placed before a panel of at least three members of the Grievance Committee. You will also be furnished with a copy of the reply to the complaint, as well as the actions and recommendations of the Grievance Committee. Should there be a hearing scheduled before a Professional Standards Hearing Panel, you will be notified well in advance, in order that you may be represented by counsel, if you wish, and in order that you may call whatever witnesses you desire.
